Amendment to Payment of Wages Act w.e.f 12-09-2012

Attached is a copy of the notification S.O. No.2260(E) Published in the Gazetteof India (extraordinary) part II, Section 3, Sub section (ii), dated 20th September, 2012.Ministry of Labour and Employment, Government of India, has revised the wage ceiling from Rs. 10,000 to Rs. 18,000 under the payment of wages act, with effect from 12th September 2012.

    is there any update in the payment of bonus? what is the current ceiling for payment of bonus? can anybody update on it?

  2. Hi Kavitha,

    The last amendment to the Act raised the eligibility ceiling of wages for the purpose of calculating bonus to Rs. 10,000/-. The maximum wage limit has also been enhanced to Rs. 3500/-.

    I would like to know , if there is any ceiling or maximum amount receivable or payable as bonus annually .

    Please clarify , Rs 10, 000 limit is what ?

    Pl. clarify this “revised the wage ceiling from Rs. 10,000 to Rs. 18,000 under the payment of wages act, with effect from 12th September 2012.

    This date is effective from date of case file or date of out of employee.

    Means whose employee file case in labor court. If Employee out from office in 1st April 2012 and his salary that time rs.17000/-. can employee file case in 2013. or not.

    If the contention is the applicability of the Act then the court should not entertain it as the cause of action did not exist at that point.
